Who Can Access Elgin Death Records
Illinois restricts who can obtain a certified copy of a death certificate. Under 410 ILCS 535/24, eligible requesters are the deceased's spouse, parent, child, grandparent, grandchild, and siblings. People with a legitimate legal need can also get a certified copy. This includes attorneys acting on behalf of an eligible party, individuals with a court order, and anyone who can demonstrate a direct and tangible interest in the record.
For older records used in genealogy research, access rules may be more flexible. Ask the Kane County Clerk specifically about genealogical copies if that is the purpose of your request. Genealogical copies are not certified for legal use, but they are useful for family history research. Records more than 50 years old may be subject to broader access under state archival policies.
Death Certificate Fees
Kane County sets its own fee schedule. Contact the clerk at 630-232-5950 to confirm the current fee before submitting your request. VitalChek orders include an additional service fee charged by VitalChek. Fees are non-refundable even if the search comes back with no record. Confirm the name, date, and county before paying to avoid errors.
If you need a statewide record or are not sure which county holds the record, the Illinois Department of Public Health charges $19 for the first certified copy and $4 for each additional copy. Genealogical copies at the state level cost $10.
